General Terms and Conditions of Use

The Bearden High School Foundation (the "Foundation") exists to assist students, parents, administration, faculty and staff in making Bearden High School (the "School") a place of academic, athletic and artistic excellence, by funding programs, acquisitions and scholarships beyond those afforded by the general school budget for present and future needs.

This website and the Online Directory included therein is for official School and Foundation use, and also for individual communication of a personal nature between members listed herein. Use of this directory for any other purpose, including, but not limited to, reproducing and storing in a retrieval system by any means, electronic or mechanical, photocopying or using the addresses or other information contained in this directory for any private, commercial, or political mailing is strictly prohibited and is in direct violation of copyright and constitutes misappropriation of corporate property

Unless otherwise noted, all materials contained on this website are copyright protected. Materials may be downloaded and/or reprinted for personal use only. Permission to reprint or electronically reproduce any document or graphic in whole or in part for any non-personal or commercial use is expressly prohibited unless prior written consent is obtained from the respective copyright holder(s).



Privacy, Information Collection and Information Use

When you browse any of the Foundation's web pages, you do so anonymously. We do not collect personal information, including your e-mail address, unless you intentionally share it with us. We may log your IP address (the Internet address of your computer) to give us an idea of which parts of our web sites you visit and how long you spend there. But we do not link your IP address to anything personally identifiable. The only other information automatically provided to us is the type of computer and operating system you are using. Your browser supplies us with this information.

The Foundation collects information from various sources, including information you send us through correspondence, emails, surveys, etc. Our database is for the use of the Foundation and the School. We do not sell or share that information with third-parties except other registered users as described herein. We may supply certain of the information we collect to a publisher retained by the Foundation or Bearden High School to print a Bearden High School Alumni Directory, but any such publisher will have agreed not to sell or share that information with anyone else without the permission of the Foundation. If you supply us with or we otherwise obtain your postal or email address you may receive periodic mailings or e-mail from us with information on the Foundation and the School.

Your contact information is made available through the Online Directory to registered users. In order to become a registered user, one needs to confirm that he/she is a School alumnus by providing their name and year of graduation. There is a possibility that non-alumni could wrongfully gain access as registered users in an effort to make undesirable uses of the information contained in our database. However, the contact information available in our Online Directory is limited to information which is generally regarded as public domain information and is available from other sources. And, in an effort to discourage unauthorized and undesirable uses, this contact information is displayed for one individual at a time. Through the use of the Update Your Info form, users have the opportunity to change their preferences regarding the information that they authorize to be displayed in the Online Directory. E-mail addresses used in the Online Directory, as a matter of policy, are not revealed by the Foundation - messages are sent via blind e-mail, leaving the option to reveal an e-mail address up to each individual recipient.

The only part of the site which provides facilities for the secure transmission of information across the internet is that part which is devoted to credit card payment of donations and store transactions. Other transmissions of information in connection with the site are not secured, and while the risk of anyone intercepting and misusing such information transmitted by email is usually very low you should be aware that a determined individual with the right skills may be able to do this. If you are submitting personal information over the internet which you wish to remain private, users should be aware that there are inherent risks.



Disclaimer of Warranties

As a viewer or user of the Foundation's website, you expressly understand and agree that:


* Your use of the site is at your sole risk. This site is provided on an "as is" and "as available" basis. The Foundation and the School expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

* Neither the Foundation, nor the School, makes any warranty that (i) the site will meet your requirements, (ii) services will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of this site will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through this site will meet your expectations, (v) the website will be free of viruses or other malicious programs or files, and (v) any errors in the software will be corrected.

* Any material downloaded or otherwise obtained through the use of the site is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material.

* No advice or information, whether oral or written, obtained by you from the Foundation through or from the site shall create any warranty.



How Limitation of Liability

You expressly understand and agree that neither the Foundation, nor the School, shall be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if the Foundation and/or the School has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the site; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the site; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the site; or (v) any other matter relating to the site.
